Hiring and promotion decisions are some of the most critical employment decisions that managers make. Despite their best intentions, managers may make inadvertent mistakes or rely on personal biases when hiring, exposing the organization to significant risk at the state and federal levels. Because these decisions are so important, courts have recognized that failing to train managers on how to avoid discrimination in the hiring process amounts to “reckless indifference”.
